We have received a number of complaints about your website from customers who have submitted personal details via you in the mistaken belief that the "Accessible Odeon Website" is somehow affiliated to Odeon Cinemas Limited, which it is not. As a result of this confusion, some of our customers have expressed considerable concern to us that by registering their e-mail address and other personal details via your website, they have unintentionally and unwittingly given their personal details to you. This confusion is compounded because your website contains both content and listings that you have copied from Odeon's official website. We would add that you do not have Odeon's permission to reproduce the content and listings and that under English Law, use of them by you is actually an infringement of Odeon's copyright and database rights. Also, by using the registered trade marks "ODEON" and "ODEON Fanatical About Film" on your website, our customers have mistakenly thought that your website was either associated with or endorsed by Odeon. This is not the case and as Odeon has never granted you permission to use these trade marks you are infringing them. If you do continue to collect personal information via your "Accessible Odeon Website", you should be aware that under the Data Protection Act 1998, it is a criminal offence to knowingly or recklessly obtain or disclose personal data without the consent of the data controller of that personal data. By collecting details from our customers via the "Accessible Odeon Website", you may be committing this criminal offence. We cannot allow the current situation to continue and so we insist that you remove the "Odeon Booking Service", "Register" and "View My details" areas and Odeon links and content from your "Accessible Odeon Website" and cease using our trade marks, content and listing by no later than 5pm on Monday 5th July 2004. Kindly confirm to us that you have or will comply with the above as soon as possible. In the event that you do not comply, we reserve our legal rights to take such steps as are necessary to protect our customers and Odeon's intellectual property.
